TERMS OF SUBSCRIPTION

Srinagar Law Journal (SLJ)

1. INTRODUCTION

These Terms of Subscription (“Terms”) govern access to and use of the digital database and services provided by Srinagar Law Journal (SLJ).

By subscribing to SLJ, the user (“Subscriber”) agrees to be bound by these Terms. If the Subscriber does not agree, access to the services must not be used.

2. NATURE OF SERVICE

SLJ provides access to a curated digital repository of reported judgments, headnotes, and related legal material.

The service is informational in nature and is intended to assist legal research. It does not constitute legal advice.

3. SUBSCRIPTION & ACCESS

  • Access is granted upon successful payment of the applicable subscription fee.
  • Subscription is personal, limited, non-transferable, and non-exclusive, unless expressly agreed for institutional plans.
  • Login credentials are confidential and must not be shared.
  • SLJ reserves the right to suspend or terminate access in case of misuse or breach.

4. SUBSCRIPTION PERIOD

  • Subscriptions are valid for the period specified at the time of purchase.
  • Access shall automatically terminate upon expiry unless renewed.
  • No grace period is guaranteed.

5. PAYMENT TERMS

  • All subscription fees are payable in advance.
  • Fees once paid are final and binding.
  • Applicable taxes shall be charged additionally, where required by law.

6. NO REFUND POLICY (IMPORTANT)

  • All subscription fees are strictly non-refundable and non-cancellable.
  • No refund, whether partial or full, shall be granted under any circumstances, including but not limited to:
    • Non-usage or limited usage of the service
    • Change in requirement or preference
    • Dissatisfaction with content or features
    • Technical issues not attributable to SLJ’s wilful default
  • The Subscriber expressly agrees that access is granted immediately upon activation, and therefore, no withdrawal or refund claim shall be maintainable.

7. SERVICE AVAILABILITY

  • SLJ shall make reasonable efforts to ensure uninterrupted access.
  • However, SLJ does not guarantee continuous or error-free service and shall not be liable for:
    • Temporary downtime
    • Maintenance interruptions
    • Internet or device-related issues

8. INTELLECTUAL PROPERTY

  • All content, including judgments, headnotes, formatting, and database structure, is the intellectual property of SLJ.
  • Subscribers shall not:
    • Reproduce, distribute, or commercially exploit content
    • Create derivative databases
    • Share access beyond permitted use

Any violation shall result in immediate termination and may attract legal action.

9. RESTRICTION ON USE

The Subscriber agrees:

  • Not to use the platform for unlawful purposes
  • Not to attempt unauthorized access, scraping, or data extraction
  • Not to share login credentials or enable multiple users under a single-user plan

10. TERMINATION & SUSPENSION

SLJ reserves the right to suspend or terminate access without prior notice if:

  • There is a breach of these Terms
  • Unauthorized usage is detected
  • Payment obligations are not fulfilled

No refund shall be payable in such cases.

11. LIMITATION OF LIABILITY

  • SLJ shall not be liable for any indirect, incidental, or consequential loss arising from use of the service.
  • The Subscriber acknowledges that legal research involves interpretation, and SLJ shall not be responsible for reliance placed on any material.

12. MODIFICATION OF TERMS

SLJ reserves the right to modify these Terms at any time. Continued use of the service shall constitute acceptance of the revised Terms.

13. GOVERNING LAW & JURISDICTION

These Terms shall be governed by the laws in force in the Union Territory of Jammu & Kashmir.

Any disputes shall be subject to the exclusive jurisdiction of courts at Srinagar.
